By accessing or using GenealogyDirect’s services, website, or mobile application (collectively, the "Services"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you may not use the Services.
2. Services Provided
GenealogyDirect provides a platform connecting individuals seeking genealogical documents ("Requesters") with individuals or organizations capable of retrieving, translating, or transcribing these documents ("Service Providers"). GenealogyDirect acts solely as an intermediary and is not responsible for the quality or accuracy of the documents or services provided.
3. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement.
4. Account Registration
To access certain features, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password. GenealogyDirect is not liable for any unauthorized access to your account.
5. Requesters’ Responsibilities
Provide clear and accurate details when creating requests. Acknowledge that documents may not always be found, and fees may still apply for efforts made. Comply with all applicable laws in your use of the Services.
6. Service Providers’ Responsibilities
Fulfill requests professionally and accurately to the best of their ability. Notify GenealogyDirect if a request cannot be completed. Comply with all applicable laws, including copyright and privacy laws.
7. Payment and Fees
GenealogyDirect charges fees for facilitating transactions between Requesters and Service Providers. Fees are disclosed prior to any transaction. Payments are processed through third-party payment providers; GenealogyDirect does not store payment information.
8. Volunteer Contributions
Volunteers providing services at no cost may allocate points earned to select charities. GenealogyDirect facilitates but does not guarantee donations to these charities.
9. Prohibited Activities
You agree not to:
- Use the Services for illegal, fraudulent, or harmful purposes.
- Misrepresent your identity or affiliation.
- Violate any intellectual property or proprietary rights.
- Interfere with the operation of the Services or attempt unauthorized access.
10. Intellectual Property
All content, including but not limited to text, graphics, logos, and software, is the property of GenealogyDirect or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.
11. Disclaimers and Limitation of Liability
GenealogyDirect provides the Services "as is" without warranties of any kind. GenealogyDirect is not liable for errors or omissions in content or services provided by Service Providers, losses or damages resulting from the use or inability to use the Services, or unauthorized access to your account.
12. Rights to Documents and Metadata
By uploading documents retrieved in response to requests, you authorize GenealogyDirect to store, use, and share these documents and their associated metadata (such as dates, involved individuals, repositories, and document types) to fulfill current or future requests by other users or third parties. You confirm that you have sufficient rights to allow such usage without infringing upon third-party rights.
13. Termination
GenealogyDirect may suspend or terminate your access to the Services at any time, for any reason, without notice.
14. Governing Law
These Terms are governed by and construed in accordance with the domestic laws of the State of New York. Each of the Parties to this Agreement consents and agrees that any action to enforce this Contract or any dispute whether such dispute arises in law or equity, arising out of or relating to this Agreement shall be brought exclusively in the United States District Court for the Southern District of New York or any New York State Court sitting in New York City.
15. Amendments
GenealogyDirect reserves the right to update or modify these Terms of Use at any time. Continued use of the Services constitutes acceptance of the revised terms.
